2. Scope
These Terms and Conditions apply to purchases made through the Digilema online store. By placing an order, the customer confirms that they have read these Terms and Conditions and agrees to be bound by them.
The online store sells goods to consumers and businesses. Some consumer rights described below apply only to consumers and not to legal entities or business customers.
3. Product and price information
Product information is displayed on each product page. Product images are illustrative, but we aim to keep product descriptions, prices and availability accurate and up to date.
All prices are shown in euros and include VAT where applicable. Delivery costs are not included in the product price unless stated otherwise. Delivery costs are shown at checkout before payment.
If a product price or product information is clearly incorrect because of an obvious technical or human error, the online store may cancel the order and refund any payment received.
4. Placing an order
- Select the product and add it to the cart.
- Open the cart and check the selected products and quantities.
- Proceed to checkout.
- Enter the required billing and delivery details.
- Select an available delivery method and payment method.
- Review the order, delivery cost and total amount before confirming the order.
The purchase contract is concluded when the online store confirms the order after successful order placement and payment confirmation, unless another payment arrangement is expressly agreed.
If the ordered product cannot be supplied, we will notify the customer as soon as possible and refund the payment, including the paid delivery cost, no later than 14 days after sending the notification.
5. Payment
Available payment methods are shown at checkout. Current payment methods include card payment through Revolut, digital wallet payment where available, such as Apple Pay or Google Pay, and cash on delivery with supported Packeta delivery methods.
Cash on delivery via Packeta is available only when it is shown for the selected delivery method. The maximum total order amount for cash on delivery is €700 inclusive. For a higher amount, the customer must select an online payment method.
Payments are processed in a secure payment environment. The online store does not store full payment card details.
6. Delivery
Goods are delivered within Slovakia using the delivery methods shown at checkout. Available options may include Packeta pickup points, Z-BOX, Packeta home delivery and other delivery methods currently available for the order.
For delivery to a pickup point or Z-BOX, the customer must select a specific pickup location at checkout. The parcel will be delivered to that location; availability may change and the customer may then need to select another location.
For home delivery, a separate shipping address is used if the customer enters one at checkout. Otherwise, the goods are delivered to the billing address provided. Packeta or its contracted delivery partner may contact the customer by phone, e-mail or message with delivery, tracking or pickup information. A parcel delivered to a pickup location must be collected within the period stated in the carrier notification.
The delivery cost is shown at checkout before payment.
The estimated delivery time is 2-5 business days. This is an estimate and may be affected by stock availability, order processing, public holidays, carrier workload or events outside the online store’s direct control after the parcel has been handed to the logistics provider. If a delay occurs, we will assist the customer and communicate with the delivery provider where needed.
Unless a different delivery time is agreed, goods will be delivered no later than 30 days after the purchase contract is concluded.
The customer is responsible for providing complete and accurate delivery details. Additional costs caused by incorrect delivery information may be charged to the customer where permitted by law.
7. Right of withdrawal
A consumer has the right to withdraw from a distance contract within 14 days without giving a reason. The withdrawal period expires 14 days after the day on which the consumer or a third party indicated by the consumer, other than the carrier, receives the goods.
To exercise the right of withdrawal, the consumer must send a clear statement by e-mail to info@digilema.com. The consumer may use the withdrawal form, but use of the form is not mandatory.
The goods must be returned no later than 14 days after the consumer notifies us of withdrawal. Before sending goods back, please contact us at info@digilema.com. We will provide return instructions and the applicable return destination by e-mail.
The consumer bears the direct cost of returning the goods, except where the returned goods are incorrect, defective or otherwise non-conforming.
The consumer may inspect the goods only in the same way as would be allowed in a physical store. If the goods have been used more than necessary to establish their nature, characteristics and functioning, the online store may reduce the refund to reflect the decrease in value.
We will refund payments received from the consumer, including the cost of the least expensive standard delivery method offered by the online store, no later than 14 days after receiving the withdrawal notice. We may withhold the refund until we have received the returned goods or until the consumer has supplied evidence of having sent the goods back, whichever is earlier.
8. Exceptions to the right of withdrawal
The right of withdrawal may not apply in cases provided by law, including goods made to the consumer’s specifications, sealed goods that are not suitable for return for health protection or hygiene reasons if unsealed after delivery, sealed audio/video recordings or computer software if unsealed after delivery, and other statutory exceptions.
9. Claims, defects and warranty rights
The online store is responsible for defects and non-conformity of goods in accordance with applicable consumer protection law. The customer should notify us of a defect by e-mail at info@digilema.com and include the order number, a description of the issue and, where possible, photos or other evidence.
Goods should not be sent back without prior e-mail instructions. For returns, complaint handling or inspection, contact us first at info@digilema.com; we will provide the applicable return instructions and destination by e-mail.
If the goods are defective or do not conform to the contract, the consumer may have the right to repair, replacement, price reduction, refund or other remedies provided by applicable law.
We respond to consumer complaints by e-mail within 15 days, unless a longer period is justified by the nature of the case.
10. Personal data
Personal data are processed in accordance with the Privacy Policy available on the website of the online store.
11. Alternative consumer dispute resolution
If the consumer is not satisfied with the way we handled their complaint, or believes that we have violated their rights, the consumer may contact us at info@digilema.com and request a remedy.
If the consumer is not satisfied with our response, or if we do not respond within the statutory period, the consumer has the right to contact a competent alternative dispute resolution body.
As the seller is established in Estonia, the consumer may contact the Estonian Consumer Disputes Committee or another competent alternative dispute resolution body under applicable law.
Slovak consumers can also find information about alternative consumer dispute resolution on the website of the Slovak Trade Inspection: https://www.soi.sk.
12. Governing law
These Terms and Conditions are governed by the laws of Estonia. This choice of law does not deprive consumers of mandatory consumer protection rights that cannot be waived under the law of the consumer’s country of habitual residence.
13. Changes to the Terms and Conditions
The online store may update these Terms and Conditions from time to time. The version published on the website at the time of placing the order applies to that order.
